What is Maternity Leave in COL?
Maternity leave in Colombia (COL) is a legally mandated benefit that provides female employees with time off to recover from childbirth and bond with their newborn. It aims to support maternal health and child care during the initial stages after birth.
Duration
Female employees are entitled to 18 weeks (126 days) of paid maternity leave.
My employee is not yet a regular employee, are they eligible for this?
All female employees, including those in probationary periods, are eligible for maternity leave. They can either take it 1-2 weeks before delivery date or after childbirth.
How much should I pay my employee who availed the maternity leave?
When an employee in Colombia avails of maternity leave, you as the employer are required to continue paying 100% of her regular salary for the full duration of the leave. The payment should be made according to her usual payroll schedule, just as if she were actively working.
How would this look like in my invoice/billing?
This will be reflected one-time on your invoice and will be credited back to you once the claim from the Colombian Social Security System is available, between 1-6 months.
