What is a Maternity Leave in PH?
A Maternity Leave in the Philippines (PH) allows female employees to take leave to prepare and recover from childbirth (or miscarriage/emergency termination of pregnancy). This is in accordance with Philippine Labor Law where it states that all pregnant employees are entitled to maternity leave and benefits under the Social Security System (SSS).
Duration
- A female employee is entitled to 105 Days Paid Leave whether they give birth via normal delivery or caesarean section. An additional 15 Days Paid Leave for Solo Parents.
- However, female employees have the option to extend their maternity leave by 30 days, but this extension will be unpaid.
- If the pregnancy ends in a miscarriage or the employee suffers an emergency termination of pregnancy (including stillbirth), she is entitled to 60 Days of Paid Leave.
How would this look like in my invoice/billing?
This will be reflected as a one-time charge on your invoice once we receive the final calculation. The total amount will depend on the calculation that we receive from the HR Team or HR Supplier.
My employee is not yet a regular employee, are they eligible for this?
Yes. Employees on probationary period and regular employees that have contributed to their Social Security System (SSS) for at least three (3) months in the twelve (12) month period immediately preceding the semester of her childbirth, miscarriage, or emergency termination of pregnancy are eligible for the maternity leave.
When can they start their maternity leave?
Under the Expanded Maternity Leave Law (Republic Act No. 11210) in the Philippines, a female employee can begin her maternity leave at any point before or after childbirth, depending on her preference or medical necessity.
A female employee can start her maternity leave 45 days before the expected date of delivery
If the employee opts not to take any leave before delivery, she can use the full 105 days (or 120 days for solo parents) after childbirth.
